The agreement
These terms are an agreement between you and Kitakaya LLC ("Kitakaya", "we", "us") about the Habit Jr. app and service. By creating an account, subscribing, or using Habit Jr., you agree to them. If you do not agree, do not use the service. Habit Jr. is offered only in the United States.
You must be an adult (18 or older, or the age of majority where you live) to create an account, subscribe, or agree to these terms. Children use Habit Jr. only on a device a parent or guardian has linked, under that adult's supervision.
What Habit Jr. is
Habit Jr. helps families plan daily routines, lets children check off tasks, and shows progress, stickers, and reviews. It is a family organizing tool. It is not medical, psychological, educational, or parenting advice, and it does not replace an adult's supervision or judgment.
We keep improving the service, so features may change, be added, or be removed. If we remove a paid feature you rely on, we will tell you in the app first.
Your family account
The parent who creates a family is its owner and is responsible for it. In particular:
- You are responsible for the adults you invite (co-parents and caregivers) and the permissions you give them, and for the devices you link to your children.
- Keep your Apple account and your devices secure. Tell us if you think someone has accessed your family without permission.
- Give us accurate information, and only add children you are the parent or legal guardian of, or have that person's permission to add.
Children's privacy
Children do not create accounts. A parent agrees to our notice to parents before we collect any information about a child. Our privacy policy explains what we collect, how we use it, and how to see, export, or delete it. It is part of these terms.
Subscriptions and payment
Habit Jr. is free for 14 days, starting when the account holder first chooses on the subscription offer (subscribing or choosing "Not now"). After that, using Habit Jr. needs a Habit Jr. Family subscription, which covers the whole family. Prices are shown in the app before you buy.
If the free days end without a subscription, the family is locked until the account holder subscribes. Your family's data is kept, and you can still sign in, export it, or delete it. Only the account holder can subscribe for the family.
- Subscriptions are sold and billed by Apple through the App Store, to the Apple account you use to subscribe. Apple's terms and payment methods apply.
- A subscription renews automatically for the same period and price unless you cancel at least 24 hours before the current period ends. Your Apple account is charged within 24 hours before each renewal.
- You can manage or cancel your subscription at any time in your device's Settings, under your Apple account's Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you already paid for. Deleting the app or your family does not cancel a subscription.
- If a free trial is offered, it turns into a paid subscription when it ends unless you cancel at least 24 hours before. Any unused part of a trial ends when you subscribe.
- If we change a subscription's price, Apple will tell you before the change applies, and ask for your agreement where the law or Apple requires it.
- Refunds are handled by Apple under its policies. We cannot issue App Store refunds ourselves, but we will help you ask Apple for one.
- If your plan allows it, a subscription may be shared with your Apple Family Sharing group as Apple allows.
Stickers and in-app items
Stickers, buddy looks, records, and other items in the app are part of the service. They are earned by using it, have no money value, and cannot be bought, sold, traded, transferred, or exchanged for money. They end if the child's profile or the family is deleted.
Friend families
If you invite another family or join theirs:
- Only invite families you know and trust. You decide which of your children are shared and can stop at any time.
- Crew names and anything else you enter must be suitable for children. No offensive, hateful, sexual, or personal information in a crew name.
- We may rename a crew, remove a family from a crew, or turn friend features off for a family that breaks these rules.
Using the service fairly
Do not:
- Use the service for anything unlawful, or to harm, harass, or exploit anyone, especially a child.
- Try to access another family's information, get around our security or the limits we set, or interfere with the service.
- Copy, change, reverse-engineer, resell, or build a competing product from the app, except where the law allows it despite this restriction.
- Use bots, scrapers, or automated tools against the service.
Your content and ours
The plans, task names, and other content you add belong to you. You let us store, copy, and display it only as needed to run the service for your family; we do not sell it or use it for advertising.
The app, its design, the buddy characters, stickers, and artwork belong to Kitakaya LLC or our licensors. We give you a personal, non-transferable, revocable license to use the app for your family, on Apple devices you own or control, as these terms and the App Store's rules allow.
Ending your use
You can stop using Habit Jr. and delete your family at any time in Settings. Remember to cancel any subscription with Apple too.
We may suspend or end access for a family that seriously or repeatedly breaks these terms, or where the law requires it. If we end the service as a whole, we will give reasonable notice where we can. What happens to your information is set out in the privacy policy.
Disclaimers
We work hard to keep Habit Jr. available, accurate, and safe, but it is provided "as is" and "as available". To the extent the law allows, we do not promise that it will be uninterrupted, error-free, or produce any particular result for your family, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Habit Jr. is not for emergencies or for supervising a child's safety, health, or medication. Always rely on a responsible adult for those.
Limits on our liability
To the extent the law allows, Kitakaya is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the service. Our total liability for any claim about the service is limited to the greater of what you paid us for the service in the 12 months before the claim, or US $50.
Some places do not allow these limits, so they may not apply to you. Nothing in these terms limits rights you have that the law says cannot be limited.
Disagreements
If you have a problem, please contact us first at [email protected]; most issues can be sorted out quickly. These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any case that can't be resolved informally will be brought in the state or federal courts located in Orange County, California, except that either of us may bring a claim in small-claims court if it qualifies.
California users
Under California Civil Code section 1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be reached in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (916) 445-1254 or (800) 952-5210.
Apple and the App Store
Because you get Habit Jr. from the App Store:
- These terms are between you and Kitakaya LLC only, not Apple. Kitakaya, not Apple, is responsible for the app and its content.
- Your license to use the app is limited to Apple devices you own or control, as the App Store's Usage Rules allow.
- Kitakaya, not Apple, is responsible for maintenance and support. Apple has no obligation to provide either.
- If the app fails to meet a warranty that applies, you may tell Apple, and Apple will refund the app's purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
- Kitakaya, not Apple, is responsible for any claims about the app, including product liability, failure to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- If someone claims the app infringes their intellectual property, Kitakaya, not Apple, is responsible for investigating, defending, settling, and discharging the claim.
- You confirm that you are not in a country subject to a US government embargo or designated as supporting terrorism, and that you are not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes to these terms
We may update these terms. If a change matters, we will tell you in the app before it applies. If you keep using Habit Jr. after the change takes effect, the new terms apply; if you do not agree, you can stop using the service and cancel your subscription.
